THE 2024 STAYING INSIDE THE LINES SOCCER SWEEPSTAKES – OFFICIAL RULES

SWEEPSTAKES PERIOD: The 2024 Staying Inside the Lines Soccer Sweepstakes (the “Sweepstakes”) begins at 10:00AM Eastern Time (“ET”) on March 1, 2024 and ends at 11:59PM ET on June 30, 2024 (the “Sweepstakes Period”).
ELIGIBILITY: Open to legal residents of the 50 United States and D.C. and Canada (excluding the Province of Quebec) who are employed as residential and/or commercial painting professionals 18 years of age or older and the age of majority in their jurisdictions of residence as of date of entry. Void in Quebec and where prohibited or restricted by law. Employees of Shurtape Technologies, LLC (the “Sponsor”), The Sherwin-Williams Company (the “Promotional Partner”), their respective affiliates, parents, subsidiaries, divisions, suppliers, distributors, and advertising, promotional and judging agencies (collectively the “Sponsor and its Administrators”) and each of their respective employees, shareholders, directors, officers, members, assigns and agents and their immediate family members and/or those living in the same household of each are not eligible to participate or win.
HOW TO ENTER: There are two (2) ways to participate, via Entry Form/Mail or via Website:
Via Entry Form/Mail: During the Sweepstakes Period, you may enter by completing the official Sweepstakes Entry Form which can be found at participating Sherwin-Williams retail paint stores and mailing the completed entry to: 2024 FrogTape/Sherwin-Williams Soccer Sweepstakes, PO Box 7758, Melville, NY 11775-7759 USA or you may also enter by printing your first and last name, complete mailing address (no Post Office Boxes please), daytime telephone number, email address (if available) and your age on a 3” x 5” piece of paper, inserting in a #10 standard envelope and sending to the address above for one (1) entry into the Sweepstakes (the “Mail-In Entry”). The person listed on the Entry will be deemed the entrant (the “Entrant”). Entries must be postmarked by June 30, 2024 and received by July 8, 2024 to be eligible.
Via Website: During the Sweepstakes Period, visit www.frogtape.com/swsweepstakes (“Website”) and follow the instructions to complete and submit the registration form provided to receive one (1) entry into the Sweepstakes (“Website Entry”). If you enter using your web-enabled mobile device, standard data rates may apply. See your wireless provider for pricing plan details. Wireless service may not be available in all areas. Normal Internet access and usage charges imposed by your online service provider may apply.
There is a limit of one (1) Entry per person, regardless of method of entry. Mail-in Entries and Website Entries will hereby be referred to as an “Entry” or “Entries.” Entries submitted in excess of any stated limitation will be void. No photocopies, facsimiles or mechanical reproductions of Mail-In Entries will be accepted. All Entries shall be the property of the Sponsor and will not be returned.
RANDOM DRAWING: The winners will be selected in a random drawing to be held on or about July 15, 2024 from among all eligible Entries received. The odds of winning will depend on the number of eligible Entries received throughout the Sweepstakes Period. The random drawing will be conducted by an independent judging organization whose decisions are final on all matters relating to the Sweepstakes.
WINNER NOTIFICATION/VERIFICATION: The potential winners will be notified via mail or email at the street address or e-mail address provided during Entry submission and will be required to sign and return a Declaration of Eligibility & Liability Release and where legal, a Publicity Release within five (5) days of notification attempt. Noncompliance within this time period may result in disqualification and an alternate winner may be selected. In order to be eligible to win the prize, a potential winner who is a Canadian resident must correctly answer, unaided, a time-limited mathematical skill-testing question as posed by Sponsor. Any prize notification returned as non-deliverable or if potential winner is not eligible will result in disqualification and the prize will be forfeited and an alternate winner may be selected and notified as indicated above. Travel companions of the Grand Prize winners (or Grand Prize winner on behalf of travel companion if travel companion is a minor and winner’s child/charge) will be required to execute a Release of Liability and Publicity Release prior to travel.
PRIZES AND APPROXIMATE RETAIL VALUE (THE “ARV”): Two (2) Grand Prizes: A trip for the winner and one (1) travel companion to a professional regular season soccer game in Miami, FL USA. Trip includes round trip economy air transportation from major airport closest to winner’s home to Miami, FL USA, two (2) nights double occupancy hotel accommodations, two (2) tickets to a regular season professional soccer game and $500 USD spending money for ground transportation and incidentals, awarded as a check. (ARV: $5,750 USD each). In lieu of the complete Grand Prize trip (description above), winner may elect to receive a cash prize awarded in the form of a check for $5,750 USD. Fifty (50) First Prizes: A FrogTape branded cooler and Sponsor-specified FrogTape Painter’s Tape & FrogTape branded merchandise (ARV: $150 USD each). The total ARV of all prizes is $19,000 USD. No substitution or transfer of prize permitted, except as permitted by Sponsor in their sole discretion. Sponsor may award a substitute prize of comparable or greater value if any prize listed becomes unavailable for any reason. There is a limit of one (1) prize per person. Grand Prize winner, unless prohibited by law, may be asked by the Sponsor to claim the Grand Prize by visiting a designated local authorized Shurtape dealer or Sherwin-Williams retail paint store, as determined by the Sponsor, to participate in a Grand Prize award ceremony and photo session. By participating in the award ceremony and photo session, Grand Prize winner agrees that Sponsor owns all of that footage and may use any of that footage in any way they see fit.
GRAND PRIZE TRIP RULES: All applicable taxes and all other expenses and costs not expressly listed above, including, but not limited to, airline baggage fees, taxes, tips, entertainment, transfers, and transportation to airport to and from winners’ home residence are the winners’ sole responsibility. Actual retail value of Grand Prize trips may vary due to winners’ residences and time of travel. Grand Prize winners and their respective travel companions must travel at the same time on same itinerary as set by Sponsor/Administrator. Grand Prize trips must be booked at least thirty (30) days in advance and must be completed in 2024. Certain restrictions and blackout dates may apply. Grand Prize winners and their travel companions must possess valid travel documents (i.e., valid government issued photo ID, passport, etc.) in order to travel. Failure to obtain required travel documents by Grand Prize winners may result in forfeiture of prize and alternate selection. No refunds or credit for changes are allowed. If a Grand Prize winner chooses to travel without a travel companion, the prize will be awarded in increments appropriate for one (1) traveler (i.e., the Grand Prize winner) and winner will not receive additional compensation of any kind in conjunction therewith. Winners and travel companions must agree to follow any applicable COVID protocols that may be in place at time of travel. Airline tickets are for travel from major airport nearest winner's home to the destination city. Airline carrier's regulations and conditions apply. Seat selection and timing of trip are subject to travel, game ticket availability and confirmation of reservations. No refunds or credit for changes are allowed. In the event a Grand Prize winner lives within one-hundred fifty (150) miles of the destination city, round-trip ground transportation or additional cash stipend will be provided in lieu of air transportation and no additional compensation will be provided. A minor going on the trip as the travel companion of the Grand Prize winner must be accompanied by a parent or legal guardian at all times (i.e., the Grand Prize winner).
GENERAL RULES: For U.S. Grand Prize winners, a 1099 tax statement will be filed with the IRS for the actual total value of the prize and the 1099 form will be sent to the Grand Prize winners via mail, to be processed by the applicable winner in the year in which he or she receives the prize. By participating in this Sweepstakes, Entrants agree to be bound by these Official Rules and the decisions of the Sponsor. All applicable laws and regulations apply. Entrants and winners hereby hold the Sponsor and its Administrators, Promotional Partner and each of their respective officers, directors, members, managers, employees, agents, representatives, successors and assigns (the “Released Parties”) harmless from and against any third-party claim arising from use of any entry and Entrants waive any right to inspect or approve uses of your entry by Sponsor in connection with the Sweepstakes or to be compensated for any such uses. Participating in the Sweepstakes constitutes permission to the Sponsor to use a winner’s name, address, and likeness in connection with the administration of the Sweepstakes only and as otherwise required by law. By participating in the Sweepstakes, the Entrant agrees that Released Parties will have no liability whatsoever for, and will be held harmless by Entrant for any liability for any bodily injury, loss or damages of any kind to persons, including death, and property, due in whole or in part, directly or indirectly, from entry, the acceptance, possession, use or misuse of prize or component thereof, if applicable, or participation in the Sweepstakes or participation in any Sweepstakes related activity. You hereby represent and warrant that you have read these Official Rules and are fully familiar with their contents and agree to be bound by them. The Sponsor is not responsible for any typographical or other error in the printing of the Sweepstakes materials or the offering or announcement of the prizes. Receipt of Entries may be acknowledged, but such acknowledgment is not binding upon Sponsor or Administrator. The use of script, macro, or automated devices (or any other devices intended to automate or subvert any aspect of participation) to enter is prohibited. If Sponsor, in its sole discretion, determines that an Entrant has used an automated or similar device to enter or is otherwise in violation of these Official Rules, all Entries received by that Entrant will be void. Sponsor and its Administrators are not responsible for lost, late, incomplete, damaged, or misdirected Entries/winner notification documents; lost, interrupted, or unavailable network, server, or other connections; or miscommunications, computer, or software malfunctions, telephone transmission problems, technical failures, garbled transmissions, damage to a user's computer/phone equipment (software or hardware), or other errors or malfunctions of any kind, whether human, mechanical, electronic, or otherwise. Proof of entry will not be deemed to be proof of receipt by Sponsor. Sponsor reserves the right to cancel, suspend, and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion, and in the event of cancellation, the prizes will be awarded in a random drawing from among all eligible Entries received in accordance with these Official Rules prior to cancellation. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS SWEEPSTAKES OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW; SHOULD ANY SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right at its sole discretion to disqualify any individual it finds: to be attempting to tamper with or undermine the entry process, and/or the legitimate operation of the Sweepstakes; to violate the Official Rules; or, to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person. If, for any reason, the Sweepstakes is not capable of running as planned by reason of pandemic, travel restrictions, strikes, natural disasters, or any other factors beyond Sponsor’s reasonable control that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor may, in its sole discretion, void any suspect Entries and (a) modify the Sweepstakes or suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (b) award the prizes at random from among all eligible Entries received in accordance with these Official Rules prior to cancellation.
DISPUTES: ENTRANT AGREES THAT: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS SWEEPSTAKES OR ANY PRIZES AWARDED SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND EXCLUSIVELY BY THE APPROPRIATE STATE OR FEDERAL COURT LOCATED IN OHIO IN THE U.S.; (2) ENTRANT HEREBY WAIVES HIS/HER RIGHT TO SWEEPSTAKES JURISDICTION; (3) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES BUT IN NO EVENT ATTORNEYS’ FEES; AND (4) UNDER NO CIRCUMSTANCES WILL ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the state of Ohio in the U.S., without giving effect to any choice of law or conflict of law rules (whether of the state of Ohio or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the state of Ohio in the U.S.
PRIVACY: Any personally identifiable information collected during your participation in this Sweepstakes will be used by Sponsor and its agents for purposes of the proper administration and fulfillment of the Sweepstakes as described in these Official Rules, and in accordance with Sponsor's Privacy Policy, posted at http://frogtape.com/privacy and as allowed by law. Non-U.S. residents understand their information will be transferred to the U.S.
