THE DISNEY TREASURE CONTEST

OFFICIAL RULES

*NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN, NOR WILL A PURCHASE IMPROVE ONE’S CHANCES OF WINNING. ONLY DISNEY+ SUBCRIBERS WHO WERE SUBSCRIBERS BEFORE MAY 7, 2024 CAN PARTICIPATE IN THIS CONTEST.  VOID WHERE PROHIBITED.

BY ENTERING THE CONTEST, ENTRANT AGREES TO THESE OFFICIAL RULES.

1. SPONSOR, ADMINISTRATOR AND PRIZE PROVIDER: The Walt Disney Company (Canada) Ltd, 200 Front St. West, Toronto, ON Canada, M5V 3L4, 29th Floor (“Sponsor”); Simon Pure Marketing, 515A Pape Avenue, Toronto ON, Canada M4M 2R6 (“Administrator”); and Walt Disney Parks and Resorts, a division of The Walt Disney Company (Canada) Ltd., 200 Front Street West, Suite 2900, Toronto, ON Canada, M5V 3L4 (“Prize Provider”).

2. ELIGIBILITY: To be eligible for this contest (“Contest”), at the time of entering you must be: [a] a current Disney+ subscriber who has been a subscriber in good standing since before April 30, 2024; [b] at least 18 years of age or older or the age of majority in your province of primary residence (whichever is older); and [c]a legal resident of, and physically located in, Canada (excluding Quebec) (collectively, “Territory”). Entrants cannot be employees of Sponsor, Administrator, Prize Provider, their parent, subsidiary or affiliated companies, or of the advertising, promotional or fulfillment agencies of any of them (individually and collectively, “Entities”), or members of their respective households (defined as people who share the same residence at least three (3) months a year, whether related or not) or immediate families (defined as parents, children, siblings, step-parents, step-children, step-siblings and their spouses). Void where prohibited and subject to all applicable federal, provincial, local and municipal laws and regulations.

3. ENTRY: This Contest will begin on May 8, 2024 starting on or about 10:00 AM and ending on May 29, 2024 at 11:59 PM (“Entry Period”). For purposes of these Official Rules (“Rules”), all times and days are Eastern Time. Sponsor’s computer shall be the official timekeeper for all matters related to this Contest.

To participate in the Contest, you must visit https://www.disneycanadacontesting.com   and fill out the entry form (each an “Entry” and collectively referred to herein as “Entries”) by providing the following information:

(a)           Your first and last name;

(b)           Your email address;

(c)           A response to the following question: What are three Disney+ titles that inspired experiences onboard the Disney Treasure? (the “Question”)

Your answer to the Question must be correct in order for your Entry to be valid. Incomplete Entries will be disqualified.

Your Entry must be received during the Entry Period. LIMIT ONE (1) ENTRY PER PERSON. Normal internet access and usage charges imposed by your online service and/or mobile device may apply. 

4.  LIMITATIONS: In the event of a dispute regarding the identity of the person submitting an Entry, the Entry will be deemed to be submitted by the person in whose name the email address associated with the Entry is registered. Entries by any method other than set forth above in Section 3 are void. Any use of automated or programmed methods of effecting entry is prohibited. Neither the Entities nor any of their officers, directors, shareholders, employees, agents, or representatives (individually and collectively, “Releasees”) are responsible for Entries from persons residing, or physically located, outside the Territory; or Entries that are altered, delayed, deleted, destroyed, forged, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, irregular in any way, late, lost, misrouted, multiple, non-delivered, stolen, tampered with, unauthorized, unintelligible or otherwise not in compliance with these Rules; or for lost, interrupted or unavailable network, server or other connections; miscommunications; failed phone, computer hardware or software or telephone transmissions; technical failures; unauthorized human intervention; traffic congestion; garbled or jumbled transmissions; undeliverable emails resulting from any form of active or passive email filtering; insufficient space in entrant’s email account to receive email; or other errors of any kind, whether due to electronic, human, mechanical, printing, production or technical errors or other causes; even if caused by the negligence of any of the Releasees. Each of such potential Entries will be disqualified, and any attempt by a person to use multiple email addresses to enter more than once may result in disqualification at Sponsor’s sole discretion. Proof of submission of Entry does not constitute proof of receipt of same.

5. PROCEDURES:  Entries for the Contest will be accepted only during the Entry Period.  On or about May 30, 2024, Administrator will randomly select one (1) potential winner from among all eligible Entries received. Only Entries that contain a correct response to the Question will be considered eligible to be entered into the random drawing. Odds of winning depend on the total number of eligible Entries received. 

6. WINNER: Potential winner will be required to answer correctly a time limited mathematical skill testing question (“Skill Testing Question”) without assistance of any kind whether mechanical or otherwise to be declared a winner and be eligible to collect their Prize (as defined in Section 7 below). Sponsor will email potential winner, at the email address provided on their Entry, on or about May 31, 2024 (the “Notification”) asking for their full name, date of birth, their residential/mailing address, and for a response to the Skill Testing Question and the return of any required winner related documents, including without limitation, a declaration and release of liability (“Winner’s Forms”). In order to be declared a winner, you must meet the eligibility requirements in Section 2 above, respond to Sponsor’s Notification within twenty-four (24) hours after its transmission, give a correct response to the Skill Testing Question and return any and all Winner’s Forms within two (2) days of receiving such forms.   

At the sole discretion of the Sponsor, disqualification, forfeiture and the selection of an alternate winner may result from any of the following: [a] potential winner’s failure to respond to Sponsor’s Notification within twenty-four (24) hours after their transmission; [b] potential winner’s failure to return any and all Winner’s Forms within two (2) days of receiving such forms; [c] the return of any notification or Prize as undeliverable; [d] potential winner’s failure to provide Sponsor with satisfactory proof of age, identity and residency; [e] Sponsor’s inability to establish proof of potential winner’s Disney+ subscriber status; [f] potential winner’s failure to correctly answer the Skill Testing Question (as detailed above); [g] potential winner’s failure to validly claim a Prize no more than twenty-four (24) hours after verifying eligibility; and [h] any other non-compliance with these Rules. In the event of a Prize forfeiture, the Sponsor may, in its sole discretion, award or not award the forfeited Prize to an alternate winner, time permitting. All taxes are solely the responsibility of the winner (if applicable).

7. PRIZE AND APPROXIMATE RETAIL VALUE (“ARV”): There will be one (1) prize awarded consisting of a 7-night Disney Cruise Line vacation aboard the Disney Treasure cruise ship, sailing December 21 – 28, 2024 and leaving from Port Canaveral, Florida, and one (1) pre-night stay on December 20, 2024 at the Walt Disney World Resort prior to the cruise (“Vacation Package”) for the winner and up to three (3) travelling companions (each a “Guest”; collectively “Guests” and together with winner, the “Group”). The Vacation Package includes the following components:  

Walt Disney World Resort stay includes:

A.   Up to four (4) round-trip economy airfares for the Group between the closest major international airport to winner’s residence in Canada (“Departure Airport”) and the Orlando International Airport in Orlando, Florida, United States (“Arrival Airport”) with possible layovers (airports and flights to be selected by Prize Provider in its sole and absolute discretion);

B.   Ground transportation for up to four (4) persons, or voucher(s) for local ground transportation service, from the Arrival Airport to the Walt Disney World Resort (ground transfers to be selected by Prize Provider in its sole and absolute discretion);

C.   Room accommodations consisting of one (1) standard room (with a maximum of four (4) persons per room) at a Walt Disney World Resort hotel (hotel selection at the discretion of the Prize Provider) for one (1) night on December 20, 2024, prior to the Disney Treasure departure;

D.   Up to four (4) 1-Day Theme Park Tickets with Park Hopper Option; and

E.   One (1) Disney Dine Card for the winner with a value of Three Hundred U.S. Dollars ($300 USD), which may be redeemed for meals at select participating dining establishments at the Walt Disney World Resort during the stay.

Disney Cruise Line vacation aboard the Disney Treasure cruise ship includes:

A.   Ground transportation for up to four (4) persons, or voucher(s) for local ground transportation service, from the Walt Disney World Resort to Port Canaveral, FL, and from Port Canaveral, FL to the Arrival Airport (ground transfers to be selected by Prize Provider in its sole and absolute discretion);

B.   One (1) stateroom aboard the Disney Treasure (location/category at the discretion of the Prize Provider), sailing from December 21 – 28, 2024, with a maximum occupancy of four (4) people;

C.   All meals onboard the Disney Treasure (excluding specialty and fine dining);

D.   Pre-paid onboard gratuities for the stateroom host/hostess, dining room server, assistant server and head server;

E.   Taxes, Fees, and Port Expenses (as defined on the Disney Cruise Line website).

All costs and expenses not expressly stated in the Vacation Package description above are excluded and solely the responsibility of the winner and/or Guests, including but not limited to: transportation between winner’s residence and the Departure Airport, airport parking fees, baggage fees, insurance (health, travel, medical); shore excursions; laundry service; nursery charges; spa treatments; alcoholic and specialty non-alcoholic beverages (including specialty coffee); individually charged snacks and treats (including but not limited to movie popcorn, packaged candy, ice cream, gelato, pastries, and bar snacks); local and long distance telephone calls; ship to shore communications including internet; merchandise and souvenirs; tips and gratuities not specifically set forth above; or any other charges not explicitly included in these Rules.

The total ARV of the Prize is Thirty-Four Thousand Two Hundred Seventy Canadian Dollars and Eighty Cents ($34,270.80 CAD), which includes Taxes, Fees and Port Expenses (as defined on the Disney Cruise Line website). The actual value of the Prize may vary depending on a number of factors, including booking and travel dates, the number of travelers, point of departure, fluctuations of hotel rates and airfares, and fluctuations in the currency exchange rates for U.S. Dollars, and therefore may be higher or lower than the ARV. Any difference between the ARV and the actual cost of the Prize will not be awarded. The winner will not receive compensation for any element(s) of the Vacation Package that any participant(s) is unable to use for any reason, and such unused portion(s) of the Vacation Package will be forfeited.

Travel for the Vacation Package must be booked at least forty-five (45) days prior to the intended travel dates and must occur December 21 – 28, 2024 (with the 1-night pre-night stay at the Walt Disney World Resort occurring on December 20, 2024). If travel is not completed during the foregoing time periods, the Prize will be forfeited without compensation of any kind. No changes will be made to travel details once any element(s) of the travel arrangements have been booked, except in Prize Provider’s sole discretion. Block-out dates may apply. Vacation dates and accommodations are subject to availability; certain restrictions and block-out dates may apply. Prize Provider reserves the right to change the allowable travel dates, cruise ship or any other component of the Vacation Package, for any reason and in its sole discretion. No substitution of Vacation Package or any elements thereof is allowed, except in Prize Provider’s sole discretion. Ports of call, offerings and experiences onboard are subject to change, availability and cancellation without notice.

Vacation Package and Vacation Package components (including, without limitation, theme park tickets) may not be used in conjunction with any other promotion or offer, separated, sold, exchanged or redeemed for cash, traded, transferred, substituted, assigned, refunded or rescheduled to dates other than as set forth above, except in Prize Provider’s sole and absolute discretion. Vacation Package is non-commissionable. All elements of the Vacation Package (including, without limitation, the theme park tickets) must be used by the Group at the same time during the redemption of the Vacation Package. Any portion of the Vacation Package not accepted or used by winner will be forfeited.

Vacation Package is for the winner and up to three (3) Guests of the winner’s choosing. Once selected by the winner, Guests cannot be changed without the express consent of Prize Provider, which may be withheld for any reason. The winner will not receive compensation for any element(s) of the Vacation Package (including, without limitation, theme park tickets) that any Guest(s) is unable to use for any reason, and such unused portion(s) of the Vacation Package will be forfeited. If the winner chooses to bring less than the allotted number of Guests, the Vacation Package will be awarded in increments suitable for the actual number of Guest(s) with no substitute prize or compensation provided to the winner. A winner may not charge any Guest for participating in the Prize.

The winner and Guests must travel together on the same itinerary, and air transportation must be round-trip from/to the Departure Airport (with possible layovers). Prize Provider will determine airline and flight itinerary in its sole discretion. Airline carrier’s regulations and conditions apply to air travel. Airline tickets are non-refundable, non-transferable, and are not valid for upgrades. No refund or compensation will be made in the event of the cancellation or delay of any flight or cruise (as applicable). Sponsor and Prize Provider are not liable, including for any costs or expenses, if any component of the Vacation Package is delayed, postponed or cancelled for any reason and winner will not be reimbursed, and no substitution will be provided except in Prize Provider’s sole discretion.

Any damaged, expired, lost or stolen theme park tickets, Disney Dine Cards or travel vouchers will not be replaced. Disney Dine Cards are not redeemable, refundable or exchangeable for cash (except as required by law) and are subject to all terms and conditions of use as established by issuer. No part of the Prize is redeemable or exchangeable for cash and is subject to all terms and conditions of use. The Prize is awarded "as is" with no warranty or guarantee, expressed or implied, being provided by Sponsor or Prize Provider.

Theme parks, attractions and other offerings are subject to availability, closures, change or cancellation without notice or liability. Park admission, offerings and ticket options are not guaranteed. Prize Provider reserves the right to cancel any offering. To visit the theme parks, theme park reservations via the Disney Park Pass system (https://disneyworld.disney.go.com/en_CA/experience-updates/park-reservations/) AND valid admission are required for the same theme park on the same date for each person in the Group ages 3 and up. Reservations are subject to availability and are not guaranteed until a reservation is finalized. A park reservation must be made for each day of entry. The Park Hopper Option allows guests to visit more than one park per day. Each guest must make a park reservation via the Disney Park Pass system for the first theme park they plan to visit, and may take advantage of Park Hopper access after visiting their first theme park. Photo identification and credit card in good standing or cash deposit may be required at check-in at the Walt Disney World Resort hotel for incidental charges (e.g., room service, use of telephone/IT services, laundry and all other optional extra services not provided in the Vacation Package).

The winner and his/her/their Guests are responsible for having valid travel documents including government-issued identification and/or passports, as applicable. Those without proper citizenship documentation will be denied boarding.

The winner and each Guest will be required to execute a liability/publicity release and waiver form prior to booking of any travel. The winner and each guest will also be required to sign the Disney Cruise Line cruise contract before embarkation (the “Cruise Contract”). The Cruise Contract is available at www.disneycruise.com/cruisecontract. Failure to return the executed release form or to accept and sign the Cruise Contract within the specified time periods will result in forfeiture of the Vacation Package. Winner acknowledges that he/she is solely responsible for any actions, claims or liabilities of their travel party, related to any use or misuse of the Vacation Package or any related activity or travel. 

Health and safety measures and operational guidelines, ports of call and offerings may change at any time without notice. Certain onboard venues, experiences and other offerings may be modified or unavailable, will have limited capacity and will be subject to limited availability, advance reservations or even closure.

In the event the winner and/or Guest(s) engage in behavior that, as determined by Prize Provider in its sole discretion, is obnoxious or threatening, illegal, is intended to annoy, abuse, threaten or harass any other person, or is contrary to Prize Provider’s health and safety protocols, rules or policies in effect at the time of the Vacation Package, Prize Provider reserves the right to terminate the Vacation Package or other applicable experience early, in whole or in part, and send the winner and/or Guest(s) home with no further compensation.  The winner acknowledges and agrees to be solely responsible for any actions, claims or liabilities of any member of the Group.

Minors under the age of eighteen (18) not travelling with a parent or legal guardian must be accompanied by an adult over the age of twenty-one (21) in the same stateroom. The parent or guardian of any minor not travelling with a parent or guardian must appoint an adult to have custody and control over their minor and to contract on their behalf in connection with the Vacation Package. An appointment form will be included in the document package and must be signed by parent or legal guardian prior to embarkation at the Disney Cruise Line terminal.

The Prize will be awarded provided a sufficient number of eligible Entries are received and Prize is validly claimed no more than twenty-four (24) hours after verifying eligibility after which no alternate winner will be selected and no unclaimed Prize awarded.

8.  PRIVACY POLICY/DATA COLLECTION:  Information provided by you for this Contest is subject to Sponsor’s privacy policy located at http://disneyprivacycenter.com (“Privacy Policy”). By entering this Contest each entrant: [a] agrees that the Sponsor has the right to contact the entrant through the email address provided during winner verification, in order to administer and fulfill this Contest; and [b] consents to the transfer of personal information to the United States for purposes of administration of the Contest and for such other purposes as you may consent.

9. CONDITIONS: By entering this Contest and/or accepting any Prize you may win, you agree that: [a] you have all rights, permissions and consents necessary to grant the rights to Sponsor as expressed herein; [b]you will abide by and be bound by these Rules, the Sponsor’s decisions, which are final and binding, and the Privacy Policy; [c] the Entry becomes solely the Sponsor’s property and will not be acknowledged or returned;[d] you release and hold harmless the Releasees from any and all liability for claims, injuries, losses or damages of any kind, including without limitation death and bodily injury, resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of a Prize; participation in the Contest or any Contest-related activity or from any interaction with, or downloading of, computer Contest information; [e] any winner’s acceptance of a Prize constitutes the grant to Sponsor and assigns of an unconditional right to use his/her, name, address (province only), voice, likeness, photograph, biographical and Prize information and/or statements about the Contest for any programming, publicity, advertising and promotional purposes without additional compensation, except where prohibited by law; [f] in the event viruses, bugs, unauthorized human intervention, Acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, pandemics, epidemics, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond the Sponsor’s reasonable control, corrupt, prevent or impair the administration, security, fairness or proper play of the Contest, so that it cannot be conducted as originally planned, Sponsor has the right, in its sole discretion, to modify the Rules or to cancel, modify, terminate or suspend the Contest, except where prohibited by law; and in such event, to select winner(s) by such method as Sponsor in its sole discretion shall consider equitable; [g] the Releasees are not responsible for typographical or other errors in the offer or administration of this Contest, including but not limited to: human error, errors in the advertising, Rules and selection and announcement of the winner; [h]any portion of any Prize not accepted or used by any winner will be forfeited (if applicable); [i] the Releasees are not responsible for any inability of any winner to accept or use a Prize (or any portion thereof) for any reason; [j] the Sponsor has the right, at any time and at its sole discretion, to disqualify any individual it suspects to be doing any of the following: (i) tampering or attempting to tamper with the entry process or the operation of the Contest; (ii) violating the Rules; (iii) violating the terms of service, the Privacy Policy or other terms, conditions of use and/or general rules or guidelines of any Contest property or service; (iv) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person or (v) for any other good cause as determined solely by the Sponsor; [k] because any attempt by any individual to undermine the legitimate operation of this Contest is a violation of these Rules as well as criminal and civil laws, in the event Sponsor believes or becomes aware that such an attempt has been, is being, or will be made, it has the right to seek remedies and damages from any responsible individuals to the fullest extent permitted by law, including without limitation criminal prosecution; [l] all disputes, claims and causes of action at law or in equity (individually, “Claim”) arising out of or relating to this Contest, the meaning or interpretation of these Rules or any Prize awarded shall be resolved by applying the laws of Canada, province of Ontario, without regard to conflict of laws provisions therein, and shall be solely and exclusively brought in the local or federal courts within that province, provided that any and all disputes, claims and causes of action arising out of or connected solely with the Prize, shall be governed and construed in accordance with the laws of the state of Florida and in the event of any dispute, all entrants irrevocably consent to the jurisdiction of the state and federal courts located in Orange County, Florida to resolve such disputes; [m] all Claims shall be resolved individually, without resort to any form of class action; [n] all Claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event include attorneys’ fees, and under no circumstances will any entrant be permitted to obtain awards for, and you hereby waive all rights to claim, punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and waive all rights to have damages multiplied or otherwise increased; [o] Sponsor has the right to modify Prize award procedures at its sole discretion; [p] the Releasees are not responsible for the cancellation, postponement or unavailability of a Prize, and, if that should  occur, that Prize will be substituted with a prize of equal or greater value, as determined by Sponsor in its sole discretion; and [q] Releasees are not responsible for any failure of delivery of potential winner notification.
